2009 Annual Enrollment Period Toolkit With November 15 rapidly approaching, we know you are busy preparing. HAP wants to help where we can, so we have renovated our 2009 Annual Enrollment Toolkit based on your feedback from last year.
This year’s toolkit includes newly updated fact sheets, charts, and guides on a variety of Part D topics and also highlights tools gathered from SHIPs across the network. New additions include:

MIPPA: Even More Benefits for Beneficiaries
As reported in past HAP eNewsletters, the Medicare Improvement for Patients and Providers Act of 2008 (MIPPA) includes many provisions that affect Medicare beneficiaries. In a recent Weekly Alert, the Center for Medicare Advocacy provided information about MIPPA’s impact on the Welcome to Medicare physical as well as other preventive benefits.
On January 1, 2009, several changes will go into effect related to the Welcome to Medicare physical. First, Medicare now allows beneficiaries 12 months (instead of six) to get the physical exam. In addition, the annual deductible for Part B ($135 in 2009) will no longer apply to the Welcome to Medicare physical, though the 20 percent coinsurance will still apply.
The following services are included as part of the Welcome to Medicare physical:
- Review of medical and social history with attention to modifiable risk factors
- Review of potential risk factors for depression
- Review of functional ability and level of safety
- Examination to include height, weight, blood pressure measurement, and visual acuity
- Performance of an electrocardiogram (EKG) and interpretation of the EKG
- Education, counseling, and referral based on the results of the review and evaluation services described in the previous five components
- Education, counseling, and referral, including a brief written plan such as a checklist for obtaining the appropriate screening and/or other Medicare Part B preventive services
New services include:
- Body Mass Index (BMI) assessment
- End-of-Life planning
CMS Clarifies MIPPA Provision for Plans
On October 17, CMS issued a second guidance memo to Medicare Advantage and Part D plans to help clarify some confusion that came up in September around the new MIPPA marketing rules. Among other things, the memo provides clarification on such provisions as plan marketing through unsolicited contacts, cross selling, and agent/broker compensation.
In addition to this implementation guidance, CMS further advises plans of a new requirement that they must provide a disclaimer when an education event is organized, sponsored, or promoted by an MA or Part D plan. In early November, CMS will mail two more letters to beneficiaries who receive Extra Help from the Low-Income Subsidy (LIS). These letters detail changes to their plans in 2009.
The Choosers Letters, printed on tan paper, let beneficiaries know their Part D plan premium will be above benchmark in 2009 and that they will be responsible to pay a portion if they remain in that plan. CMS estimates about 620,000 beneficiaries will receive this notice.
The Reassignment Letters, printed on blue paper, inform beneficiaries about one of two things.
Version 1: Recipients of this version are currently in plans which will have premium above benchmark in 2009. If they do not change plans, they may be required to pay a portion of the premium in 2009. According to CMS, this mailing affects approximately 1.15 million beneficiaries

Version 2: Recipients of this version are currently in plans which are terminating. Unless they enroll in a new plan by December 31, CMS will reassign them to a new plan for 2009. CMS estimates about 133,000 beneficiaries will receive this notice.
CMS will post the exact numbers of mailings shortly to the Limited Income and Resources webpage. In the meantime, be aware that beneficiaries receiving either one of these letters are encouraged to contact their local SHIP to help compare and review their plan options during the upcoming AEP.

NCOA to Establish Benefit Enrollment Centers The National Council on Aging (NCOA) recently released a Request for Proposal (RFP) for state and local organizations to establish Benefit Enrollment Centers, a one-stop center that uses person-centered strategies to assist people with limited income to apply for certain benefits, including the Low-Income Subsidy and Medicare Savings Programs. NCOA will award up to 10 grants, up to $100,000 each, for a 12-month period. SHIPs, ADRCs, and AAAs are encouraged to apply. Funding is provided by the Administration on Aging.
Organizations interested in applying for the RFP must submit letters of intent by November 24 and applications by December 22. NCOA will hold two conference calls on November 17 and 20 to answer questions about the grant.
New Report Highlights Help for the Most Vulnerable A new report by Families USA, Congress Delivers Help to People with Medicare: An Overview of the Medicare Improvements for Patients and Providers Act of 2008, highlights improvements to the Medicare Savings Programs and the Part D Low-Income Subsidy. The report also notes that “people of color do not always fare as well under the [Medicare] program” (p. 5), and highlights a “few of the ways that MIPPA will seek to address health and health care disparities within the Medicare program” (p. 5).

American Diabetes Month is a perfect time to remind beneficiaries to schedule an appointment for a diabetes screening, one of the preventive benefits Medicare offers. HAP has compiled a detailed description of each Medicare preventive benefit, along with the cost of each benefit under Original Medicare.
