9. Can a plan refuse to give an enrollee its exception request form?
Part D plans must give the form to request an exception promptly to any enrollee who requests one. They cannot deny enrollees access to the exceptions process. CMS stated during the SHIP MMA Forum conference call on April 4, 2006 that if an enrollee cannot access the plan’s form in a timely fashion, an exception could be requested by writing to the plan.
