4. Would a retiree who does not know that his or her creditable coverage has ended (due to non-notification, a change of address, etc) be penalized?

There will be a Special Election Period for people whose non-Part D creditable coverage ended without their knowledge and/or through no fault of their own.  This Special Election Period will last 63 days from the end of the individual's creditable coverage or from the notice of coverage denial from a provider.
