HAP's Public Comments & General Process
Background
Part of the rulemaking process is to consider public comments received on the proposed regulation. The Administrative Procedure Act requires and details the process by which federal agencies and departments, including the Centers for Medicare & Medicaid Services (CMS), must seek comments from the public on all proposed regulations. Responses to significant issues raised by those who comment are included in the text of the final regulation, which is published in the Federal Register.
In a similar process, CMS also requests feedback to policy manuals and guidances written by the agency. While agencies are not required to respond publicly to issues raised by those who comment, calls for comments are significant opportunities to provide input on the guidances that govern the operations of CMS contractors, including Carriers, Medicare Advantage and Prescription Drug Plans, Quality Improvement Organizations, and Independent Review Entities.
